Business Contract Law in Brazil: the challenges of judicial enforcement
Brazil’s Contract Law nowadays is characterized by a set of statutes that allow judicial intervention to protect the most vulnerable party. In the field of business contract law this trend can be seen in the ubiquitous use of open concepts like social function and good faith. This approach demands from the Judiciary a task that he usually cannot fulfill properly. The object of the presentation is to describe the difficulties faced by Brazilian judges and discuss possible solutions for the improvement of the judicial enforcement of contract law.
